Report a no-show
Report a late checkout
If an artist stayed past the scheduled checkout time, report it within 24 hours of that checkout. Under the Rental Agreement (§2.2 and Exhibit B), the late checkout fee is the studio's hourly rate for each extra hour (rounded up) plus a $20 late checkout fee; you receive your usual 80% share of the extra hours. The artist is notified as soon as you submit, and Rex Studios reviews the report before anything is charged.
Report studio damage
Per the Rental Agreement: damage must be reported within 24 hours of the rental's check-in time, or before the studio's next rental — whichever comes first. Photographic evidence is required (§1.4). If it isn't reported in that window, the damage is presumed to have happened after the rental (§1.5). Submitting this form notifies Rex Studios and the artist at the same time — the artist receives an automated message and a copy of the report.

Questions artists ask most
I need a studio right now. How can I find one?
Type your city or ZIP code in Where on the Explore page and pick today in Check in to see only studios with open times left today. Open Advanced search to widen the distance (up to 100 miles) or filter for what you need. Each listing shows the studio's open days and hours, and you can book the same day as long as your check-in time falls within them. To get in fast:
- Request a few studios at once. Requests are free; you only pay once an owner approves.
- Message the owners to let them know it's short notice.
- Pay as soon as you're approved. A request that isn't paid by its check-in time cancels automatically.
Once one is paid, cancel your other requests (free) so those owners aren't left waiting.
Can I request multiple studios at once?
Yes — we recommend it, to get a quicker response. Sending a request doesn't charge you anything; you only pay after the studio owner approves it and you complete payment. Once one of your requests is approved and paid, cancel your other pending requests (free, since nothing was charged) so other owners aren't left waiting.
What if the studio owner is unresponsive?
Owners might be traveling or busy with a day job — requesting multiple studios at once improves your odds of securing one in time.
My search returns nothing. What now?
We may not have studios listed in your area yet, your filters may be too narrow, or try widening your search radius.
Can I negotiate the price?
Message the owner — if you agree on a different rate, they can adjust the listing's price before you book.
Should I bring my own engineer?
Up to you — check the listing for what equipment and software the studio provides, and whether an engineer is included, before deciding.
What does it cost to cancel a booking?
Once a studio owner has approved your request and you've paid, cancelling isn't free — the Rental Agreement sets one simple flat fee:
- Cancel any time before check-in — $20 flat fee, the rest refunded. It's the same $20 no matter how far in advance you cancel, including same-day bookings.
A request you haven't paid for yet — still awaiting the owner's response, or approved but not yet paid — can be canceled with no fee at all, since no money has moved. The fee only kicks in once you've actually paid. Full detail is in the Studio Rental Agreement.
What if equipment malfunctions during my session?
If a malfunction compromises the studio's safety or usability, contact the studio owner right away and arrange to return the studio. Then use File a claim on the booking in your Artist Dashboard and choose Equipment malfunction, within 24 hours of the rental's check-in time. When filing, you attest that you contacted the studio owner and that you forfeit all rights to any and all material recorded during the rental. If Rex Studios approves the claim, you're refunded the full rental amount — nothing is deducted — and the studio owner is charged a $20 cancellation fee.
Am I protected from legal action if there's damage or an injury during my rental?
Not necessarily. Rex Studios does not insure Artists, and nothing in the Rental Agreement guarantees that you are immune from a claim or legal action by a Studio Owner. While the Studio Owner bears primary responsibility for the studio and its insurance, and you are not liable for ordinary wear and tear or for matters beyond your direct control, a Studio Owner may still pursue a claim against you for damage or injury they can demonstrate resulted from your willful misconduct or gross negligence.
You are also responsible for your own conduct and safety, and that of any guests you bring, throughout the Rental Period. The best protection is to operate all studio equipment with reasonable care, only as intended, and within your level of knowledge — if you're unfamiliar with a piece of equipment, ask the Studio Owner or bring a qualified engineer rather than guessing. Any dispute that does arise is between you and the Studio Owner directly; Rex Studios is not a party to it. If you're concerned about personal liability, consider carrying your own liability coverage.

Questions studio owners ask most
Is there a fee to list?
Listing is free — Rex Studios only earns when you do. We take a 20% commission once a booking is paid.
How do I get notified about a booking request?
Every request from an artist shows up under Booking requests on your List your studio page — nothing is charged to the artist until you approve it and they complete payment. Approve or deny each request there; a denied request costs the artist nothing.
Can I block off dates I'm unavailable?
Yes — set your studio's open days and hours when you list it (or edit them later); bookings can only be made inside those hours.
Who is responsible if my studio is damaged, or someone is injured during a rental?
You are. Under the Rental Agreement (§§ 1.4, 1.5, 2.5, and 4.1), the Studio Owner assumes sole and exclusive financial and legal responsibility for any property damage, equipment loss, theft, or vandalism at the Studio, and for any injury sustained on the premises during a rental. Rex Studios does not provide any guarantee, insurance, or coverage for Studio Owners.
For that reason, you are responsible for procuring and maintaining your own comprehensive general liability insurance policy, along with any property and commercial crime coverage appropriate to your studio, before accepting bookings. If you intend to pursue a claim against an Artist for damage you believe they caused, the burden of proof rests entirely with you, and any such matter is to be resolved directly between you and the Artist — Rex Studios is not a party to that dispute.
How do I report damage after a rental?
Use File a claim on the booking in your Studio Owner Dashboard and choose Studio damage. Per the Rental Agreement (§§1.4–1.5), damage must be reported within 24 hours of the rental's check-in time, or before the studio's next rental — whichever comes first — including photographic evidence (at least one photo is required). Damage not reported within that window is presumed to have occurred after the rental. Submitting the report notifies Rex Studios and the artist at the same time, as §1.5 requires — the artist gets an automated message and a copy of the report on their dashboard. Your report is kept on file and can be downloaded as a PDF or Word document if it's ever needed for insurance, law enforcement, or legal purposes.
Is there a minimum price?
Yes — the minimum studio rate is $10 per hour. The listing form won't accept a lower rate.
Can I list internationally?
Not yet — Rex Studios currently only operates within the U.S.
Can I accept cash?
No — all payments must run through Rex Studios (via Stripe) for verification and to stay covered under the Rental Agreement.

Privacy Policy
Rex Studios Official LLC (referred to as "we" or "Rex Studios") is dedicated to safeguarding your privacy and providing transparency regarding how we utilize your information. To deliver our services effectively, we collect specific details about you, the Studios you list or rent, and your social network. Rest assured that we will only use or disclose your information as outlined in this Privacy Policy. Note that this policy does not cover information obtained through other channels or sources beyond our online services.
Personal information we collect
Identifying information
When you create a Member account with our Service, you share personal information such as your name, age, address, email address, and password. If you communicate with us via email, we may keep records of your email content, your email address, and our responses. Additionally, any messages you send through the Service may be retained. It's important to note that Rex Studios does not intentionally collect or store information from children aged 13 years or younger.
Payment Information
Rex Studios collects your personal payment details, including information stored on external services like Stripe, which you may use in conjunction with Rex Studios. By submitting your payment information or linking your Rex Studios account to an external payment service, such as Stripe, you grant Rex Studios permission to access and utilize this information for the purpose of providing and accepting payments for the Service. This process ensures both identity confirmation and seamless, hassle-free transactions. Usage Information
Cookies: Rex Studios places a 'cookie' on your computer or smartphone, containing a unique identification number specific to the device you're using. This cookie enhances your experience by ensuring seamless functionality and allows us to track how our service is utilized. Importantly, cookies do not collect personal information about you; instead, they provide anonymous insights into your browsing behavior. There are two types of cookies: persistent (which remains on your hard drive after closing your browser) and session-based (which disappears after you close your browser). While you can reset your browser to refuse cookies, keep in mind that disabling this feature may impact certain Service functionalities.
IP Address and Logins: We maintain a log of every visit to each web page on our Service. Each log entry includes details commonly found in the header of your web browser's request, such as the browser type, your Internet Protocol (IP) address, and the timestamp. Additionally, we may record your cookie's identification number and the URL of the last site you visited. This log information serves various purposes, including security, auditing, quality improvement, and monitoring the overall health and efficiency of our Service.
How we use your information
We will never spam you. When you use Rex Studios, we will only send you information directly related to your interactions with our service. You have control over when and how we send most messages to you (e.g., via email or SMS).
By providing your email address, you consent to us using it for service-related notices, including any legally required notifications (instead of postal mail). Additionally, we may send you activity notifications related to the service, such as updates on your rented Studios if you're a lister. You can customize these notifications or adjust their frequency and format.
Rex Studios may also send other messages related to service operation, such as notifications from other users, updates about features, and important news. These communications are directly tied to your use of Rex Studios and may include banners, ads, or promotional material. You can opt out of certain messages based on your service settings.
After you deactivate your member account, we may retain your profile information and user content for backup, archival, or audit purposes. For safety reasons, we might also keep information about Studios you've rented or listed. Rex Studios will continue to use this information for service maintenance and improvement.
Proper use
Rex Studios' support team may access your personal information in order to deliver the Service, upon your request during a support call, for safety and security purposes, as mandated by law, and to address any Service-related issues.
How we share your information
Personally Identifiable Information
Rex Studios does not rent or sell your personally identifiable information to others. However, we may share your information with listers, solely for the purpose of providing the Service to you. If we do so, these listers' use of your information will be governed by this Privacy Policy. Additionally, we may store personal data in locations beyond Rex Studios' direct control, such as servers or databases co-located with hosting providers. As our business evolves, we may engage in asset transactions, and customer, email, and visitor information could be part of those transfers. We may also transfer or assign such information during corporate divestitures, mergers, or dissolution. Any personal information or content you voluntarily post to the Service becomes public, subject to applicable privacy settings. If you remove posted information, cached or archived copies may persist, especially if other Users have saved that content. Finally, Rex Studios will only disclose personal information to third parties when required by law or subpoena, or when necessary to enforce our Terms of Service, protect against liability, assist government agencies, or safeguard the security and integrity of our site and Users.
Sharing of your information with business partners; expanded service
When providing additional services related to Rex Studios, we may collaborate with external companies. If you express interest in third-party products or services through Rex Studios, your personal information may be shared with those parties. By participating in rewards programs, contests, or other third-party programs, you authorize Rex Studios to disclose your information. These third parties are authorized to use the disclosed information as per contracts and agreements. We share only the necessary information for service provision. Keep in mind that third-party privacy policies may differ from Rex Studios', and by sharing this information, you acknowledge that Rex Studios is not responsible for third-party actions.
Aggregate information
Rex Studios shares non-personally identifiable information (such as anonymous usage data, referring/exit pages, platform types, and click counts) with interested third parties to help them analyze usage patterns related to specific Rex Studios services. Additionally, Rex Studios permits third-party ad servers or networks to display ads on the Service. These third parties use technology to deliver ads and links directly to your browser. While they automatically receive your IP address, Rex Studios does not provide personally identifiable information to these ad servers or networks without your consent. However, if an advertiser targets a specific audience and you engage with their ad, they may infer that you fit their intended audience. Keep in mind that the Rex Studios Privacy Policy does not govern third-party advertisers, so it's advisable to review their respective privacy policies for more details.
How we protect your information
Rex Studios employs reasonable physical, managerial, and technical measures to safeguard your personal information and implement privacy settings. However, we cannot guarantee the security of transmitted data. Upon receiving your information, we make efforts to secure our systems. Remember that this doesn't guarantee immunity from breaches. To enhance privacy and security, we verify your identity before granting account access. You're responsible for safeguarding your unique password and controlling email access from Rex Studios.
You control your information
When you navigate from our Service to other websites via links, our Privacy Policy no longer applies. Your interactions on those external sites are governed by their own rules and policies. It's essential to review their terms before proceeding.
Children's privacy
Rex Studios takes the privacy of young children seriously. They do not knowingly collect or solicit personal information from anyone under the age of 13, nor do they allow such individuals to register as members. If you're under 13, please refrain from sharing any personal details with Rex Studios, including your name, address, telephone number, or email address. In the event that Rex Studios inadvertently collects information from a child under 13 without parental consent, they promptly delete it. If you suspect that Rex Studios has information about a child under 13, you can contact them directly.

TERMS OF SERVICE
Terms of Service
This Agreement pertains to Rex Studios Official LLC, a peer-to-peer rental marketplace for home music recording studios. Rex Studios Official LLC ("Rex Studios," "we," or "us") offers services through its Site, web widgets, feeds, mobile Apps, third-party applications, and other mobile or web services (collectively referred to as the "Service"). These Terms of Service govern your use of and participation in the Service. As a User, you agree to abide by these terms, subject to any separate agreements Studios (such as independent home studio owners) may have with Rex Studios.
Our Service; member accounts
Connecting Users
Rex Studios connects owners of home music recording studios who want to rent out their music recording studio space and equipment (called "Studio Owners") with individuals interested in renting these services (called "Artists").
Creating an Account
To rent or list a Studio on Rex Studios, you need to establish a member account ("Account"). By applying for an Account, you authorize Rex Studios to disclose certain personal information to third parties for verification and marketing purposes. Rex Studios may accept or reject account applications at its discretion.
Account Responsibilities
You cannot use another member's Account. You must provide accurate and complete information during Account creation and keep it updated. Safeguard your account password and notify Rex Studios immediately of any security breaches or unauthorized use.
Communication Preferences
You can control your Member profile and interactions through the Settings page. By providing your email address, you consent to receive Service-related emails. By providing your cell phone number, you consent to receive Service-related SMS messages. Opting out of Service-related emails or SMS messages may affect your receipt of updates and offers.
Studio Rentals
If you rent from a Studio, Rex Studios shares your contact information with the Studio Owner for communication and marketing purposes.
Policies & procedures
Rental Contract
When using the Service for a rental, you must agree to a rental contract. The Rental Contract is an agreement between a Studio Owner (music recording studio owner) and an Artist (individual renting the music recording studio). Rex Studios is not a party to the Rental Contract.
Feedback
After each Rental, both Artists and Studio Owners are encouraged to submit feedback through the Service. Failure to submit feedback may result in being blocked from further Service use. Feedback is typically shared with Artists and Studio Owners.
Service rules
In utilizing the Service or the App, you agree to refrain from the following prohibited activities:
- Replicating, distributing, or disclosing any part of the Service in any medium, including but not limited to any automated or non-automated "scraping";
- Employing any automated system, such as "robots," "spiders," "offline readers," etc., to access the Service in a way that sends more request messages to the Rex Studios servers than a human can reasonably generate in the same period using a conventional online web browser. However, Rex Studios does grant operators of public search engines revocable permission to use spiders to copy materials from rex-studios.net solely for the purpose of creating publicly available searchable indices of the materials, but not caches or archives of such materials;
- Transmitting spam, chain letters, or other unsolicited email;
- Attempting to disrupt, compromise the system integrity or security, or decipher any transmissions to or from the servers running the Service;
- Using the Site, App, or Service in any way to bypass or secure a rental outside of the Service or to evade fees payable to Rex Studios in relation to your use of the Service;
- Taking any action that, at our sole discretion, imposes an unreasonable or disproportionately large load on our infrastructure;
- Uploading invalid data, viruses, worms, or other software agents through the Service;
- Collecting or harvesting any personally identifiable information, including account names, from the Service;
- Using the Service for any commercial solicitation purposes;
- Impersonating another individual or otherwise misrepresenting your affiliation with a person or entity, conducting fraud, hiding or attempting to hide your identity;
- Interfering with the proper functioning of the Service;
- Accessing any content on the Service through any technology or means other than those provided or authorized by the Service;
- Bypassing the measures we may use to prevent or restrict access to the Service, including without limitation features that prevent or restrict use or copying of any content or enforce limitations on use of the Service or the content therein.
Rex Studios reserves the right to permanently or temporarily terminate, suspend, or otherwise refuse to permit your access to the Service without notice and liability for any reason, including if Rex Studios determines that you have violated any provision of these Terms. Rex Studios also retains the right to remove or suspend listings for any reason, including a violation or suspected violation of these Terms. All aspects of the Service are subject to change or elimination at Rex Studios' sole discretion. Rex Studios reserves the right to interrupt the Service with or without prior notice for any reason. You agree that Rex Studios will not be liable to you for any interruption of the Service, delay, or failure to perform.
User content
Certain sections of the Service permit you to share feedback, comments, queries, images, and other forms of information, collectively referred to as "User Content". You alone bear the responsibility for any User Content that you upload, publish, display, link to, or otherwise make available ("post") on the Service. We act merely as a passive channel for the online distribution and publication of your User Content, without any guarantee of confidentiality from Rex Studios.
You agree not to post User Content that could: (i) pose a risk of harm, loss, physical or mental injury, emotional distress, death, disability, disfigurement, or physical or mental illness to yourself, any other individual, or any animal; (ii) pose a risk of any other loss or damage to any person or property; (iii) attempt to harm or exploit children by exposing them to inappropriate content, asking for personally identifiable information, or otherwise; (iv) constitute or contribute to a crime or tort; (v) contain any information or content that we consider to be unlawful, harmful, abusive, racially or ethnically offensive, defamatory, infringing, invasive of personal privacy or publicity rights, harassing, humiliating to others (publicly or otherwise), libelous, threatening, profane, or otherwise objectionable; (vi) contain any information or content that is illegal (including, without limitation, the disclosure of insider information under securities law or of another party's trade secrets); (vii) contain any information or content that you do not have a right to make available under any law or under contractual or fiduciary relationships; (viii) contain contact or other information in an attempt to bypass the Service or avoid fees associated with your use of the Service; or (ix) contain any information or content that you know is not accurate and current.
You agree that any User Content you post will not infringe upon the rights of any third party, including but not limited to any Intellectual Property Rights (as defined below), rights of publicity, and privacy rights. Rex Studios reserves the right, but is not obligated, to reject and/or remove any User Content that it believes, in its sole discretion, violates these provisions.
For the purposes of these Terms, "Intellectual Property Rights" refers to all patent rights, copyright rights, moral rights, rights of publicity, trademark, trade dress and service mark rights, goodwill, trade secret rights, and other intellectual property rights that may currently exist or come into existence in the future, and all applications for and registrations, renewals, and extensions of these rights, under the laws of any state, country, territory, or other jurisdiction.
Rex Studios assumes no responsibility and bears no liability for any User Content that you or any other User or third party posts or sends over the Service. You understand and agree that any loss or damage of any kind that occurs as a result of the use of any User Content that you send, upload, download, stream, post, transmit, display, or otherwise make available or access through your use of the Service, is solely your responsibility. Rex Studios is not responsible for any public display or misuse of your User Content. You understand and acknowledge that you may be exposed to User Content that is inaccurate, offensive, indecent, objectionable, or inappropriate for children, and you agree that Rex Studios shall not be liable for any damages you allege to incur as a result of such User Content.
Other users
You bear sole responsibility for your interactions with other Rex Studios Users. While we retain the right, we are not obligated to oversee disputes between you and other Users. Rex Studios is not liable for your interactions with other Users, or for any User's actions or inactions, regarding Rentals or the Service. You acknowledge that Rex Studios does not provide transportation services. Rather, the Service enables Artists and Studio Owners to conduct Rentals directly with each other. Although we may assist in facilitating successful transactions and resolving disputes, we do not guarantee the quality, safety, truthfulness, or accuracy of Rentals, User Content, or other services or transactions available through the Service.
If you have a dispute with one or more Users, you release us (and our officers, directors, agents, subsidiaries, and employees) from claims, demands, and damages (actual and consequential) of every kind and nature, known and unknown, associated with such disputes or your use of the Services. If you are a resident of California, you waive California Civil Code §1542, which states: "A general release does not extend to claims which the creditor does not know or suspect to exist in his or her favor at the time of executing the release, which if known by him or her must have materially affected his or her settlement with the debtor."
License grant
You maintain all ownership rights to your User Content. By uploading any User Content to the Service, you explicitly grant Rex Studios a royalty-free, sublicensable, transferable, perpetual, irrevocable, non-exclusive, global license to use, reproduce, modify, publish, list information about, edit, translate, distribute, publicly perform, publicly display, and create derivative works from all such User Content, including your name, voice, and/or likeness contained in your User Content, in whole or in part, in any form, media, or technology, whether currently known or developed in the future, for use in connection with Rex Studios' (and its successors and affiliates) business operations. You also grant each User of the Service a non-exclusive license to access your User Content through the Service, and to use, reproduce, distribute, display, and perform such User Content as allowed by the Service's functionality and these Terms.
Fees; billing; payments
Fee Structure and Billing Policies: You consent to the fees, charges, sales terms, payment, and billing policies applicable to your use of the Service, as outlined in our Rental Contract. If you rent from a Shop, your rental may be governed by a different rental contract provided by the Shop, which will be disclosed to you at the time of rental. Rex Studios reserves the right to introduce new services for additional fees and charges, or modify fees and charges for existing services, at its sole discretion. All fees and charges related to your use of the Service are non-refundable, except as explicitly stated in the Rental Contract.
Payments: If you are a Studio Owner, you have the option to set the Rental fee for your Studio as allowed by the Service; however, you must list your Studio for a nominal value (i.e., you cannot list your Studio for free). When setting up your Account, you will be asked to choose a payment method. Rex Studios will remit payments owed to you no later than thirty (30) days after the end of any calendar month in which the fees due to you are received.
Payment processing services for Artists and Studio Owners are facilitated by Stripe and are subject to the Stripe Connected Account Agreement, which includes the Stripe Services Agreement (collectively, the "Stripe Services Agreement"). By agreeing to this Agreement, you consent to be bound by the Stripe Services Agreement, which may be amended by Stripe from time to time. As a condition of Rex Studios enabling payment processing services through Stripe, you agree to provide Rex Studios with accurate and complete information about you and your business, and you authorize Rex Studios to share this information and transaction information related to your use of the payment processing services provided by Stripe.
Rex Studios reserves the right to withhold payment or charge back to your account any amounts otherwise due to us under these Terms, or any amounts due as a result of a breach of these Terms by you, pending Rex Studios' reasonable investigation of such breach. To ensure proper payment, you are solely responsible for providing and maintaining accurate contact and payment information associated with your account, which may include required tax information for certain Studio Owners whose annual payments will exceed $500, or as otherwise required by applicable law. If we believe that we are obligated to obtain tax information and you do not provide this information to us after we have requested it, we may withhold your payments until you provide this information or otherwise satisfy us that you are not a person or entity from whom we are required to obtain tax information. Any bank fees related to returned or canceled checks due to a contact or payment information error or omission may be deducted from the newly issued payment. You agree to pay all applicable taxes or charges imposed by any government entity in connection with your participation in the Service. If you dispute any payment made hereunder, you must notify Rex Studios in writing within thirty (30) days of any such payment; failure to so notify Rex Studios shall result in your waiver of any claim relating to any such disputed payment. Payment shall be calculated solely based on records maintained by Rex Studios. No other measurements or statistics of any kind shall be accepted by Rex Studios or have any effect under these Terms.
Availability
Rex Studios strives to keep the Site operational 24/7. However, there might be instances when the Site is unavailable due to maintenance, upgrades, emergency repairs, or telecommunication link or equipment failures beyond Rex Studios' control. Rex Studios will make a reasonable effort to limit such interruptions whenever possible. You acknowledge that Rex Studios is not responsible for any changes, suspensions, or discontinuations of the Site or the Service. It's important to note that the Site and Service are offered "as-is" without any warranty. You are responsible for accessing the Site and for any third-party fees (like Internet service or airtime charges) you may incur.
Exclusive ownership of rights
The Site and any associated software contain proprietary and confidential information safeguarded by intellectual property laws in relevant jurisdictions. You acknowledge that the information and materials presented via the Site are protected by copyrights, trademarks, service marks, patents, or other proprietary rights and laws. Unless expressly permitted by law or authorized by us, you agree not to alter, sell, distribute, transmit, broadcast, publicly perform, or create derivative works based on the Site, either in whole or in part. Any commercial use of the Site or any part of it is strictly prohibited by you.
Rex Studios provides you with a personal, non-transferable, and non-exclusive right and license to use the Site on a computer or other Internet device. This is provided that you do not (and do not allow any third party to) copy, reproduce, distribute, reverse engineer, or exploit any content, code, data, or materials on the Site in any way. You agree not to alter the Site in any way or form, nor to use modified versions of the Site for any purpose. We do not grant any license or other authorization to any user to use our trade names, trademarks, service marks, or other marks or logos, or those of our partners, without our separate written agreement. Marks of third parties are the property of their respective owners.
Any questions, comments, suggestions, or materials submitted to us through the Site will become our exclusive property. We will hold all rights in such materials and have the unrestricted right to use, publish, and disseminate such information for any purpose, without attribution or compensation.

Your privacy is our priority. Our Privacy Policy details the measures we take to protect your information. By utilizing our Service, you agree to the collection, usage, transfer, and processing of your personal data within the United States.
Security
We've put in place technically and organizationally sound measures aimed at protecting your personal information from unintended loss and from unauthorized access, use, modification, or disclosure. Despite our efforts, we cannot assure that unauthorized parties will never be able to bypass these measures or misuse your personal information. You accept that you are sharing your personal information at your own risk.
Indemnity
You consent to protect and absolve Rex Studios and its related entities, agents, licensors, managers, and employees, including their staff, contractors, agents, officers, and directors, from any claims, damages, obligations, losses, liabilities, costs, debts, and expenses (including attorney's fees) that may arise from: (i) your usage and access to the Service, including any data or content you transmit or receive; (ii) your breach of any of these Terms, particularly your violation of any representations and warranties; (iii) your infringement of any third-party rights, including but not limited to privacy rights, publicity rights, or Intellectual Property Rights; (iv) your violation of any law, rule, or regulation of the United States or any other country; (v) any claim or damages resulting from your User Content or any content submitted through your account; or (vi) any other party's access and use of the Service with your unique username, password, or other security code. You agree to defend Rex Studios against any such claims upon Rex Studios' request.
Disclaimer of warranties
The services and information on this Site are offered "as is" and are intended solely for informational use. Rex Studios does not guarantee that the Site will meet your requirements, be comprehensive, timely, dependable, or devoid of errors, inaccuracies, or typographical errors. Rex Studios renounces all warranties, whether explicit or implied, including warranties of merchantability, suitability for a specific purpose, or non-violation of others' rights. We do not assure that the Site will be free from errors, viruses, worms, or other harmful or destructive code.
Limitation of liabilities
Under no circumstances shall Rex Studios or any of our directors, officers, employees, agents, affiliates, or content or service providers (collectively referred to as "Protected Entities") be held liable for any direct, indirect, special, incidental, consequential, exemplary or punitive damages resulting from, or directly or indirectly related to, the use of, or the inability to use, the Site and the Services provided herein, or the content, materials and functions related thereto, including, without limitation, loss of revenue, even if advised of the possibility of such damages. The Service is managed and operated from our facilities in the United States. Rex Studios does not claim that the Service is suitable for use in other locations. Those who access or use the Service from other jurisdictions do so voluntarily and are solely responsible for complying with all applicable United States and local laws and regulations, including but not limited to export and import regulations. You are prohibited from using the Service if you are a resident of a country embargoed by the United States, or are a foreign person or entity blocked or denied by the United States government. Unless otherwise explicitly stated, all materials found on the Service are primarily intended for individuals, companies, or other entities located in the United States.
Governing law
The Service and these Terms are subject to the laws of California, disregarding any principles of legal conflicts. If any part of these Terms of Use is deemed invalid, illegal, or unenforceable, it will not affect or impair the rest of the provisions. Any disputes resulting from your use of this Site will be exclusively resolved in the appropriate state or federal courts in California. Individuals accessing this Site from other locations are doing so voluntarily and are accountable for complying with local laws, if and as they apply. Notwithstanding any contrary statute or law, any claim or action related to the use of the Service or these Terms must be initiated within one year after the claim or action arose, or it will be permanently prohibited. If you are a Studio Owner with a claim against an Artist, the Rental Contract stipulates that you must inform us before the earlier of (a) two weeks following the checkout time/date related to that Rental, or (b) the start of a subsequent Rental for the same Studio.

MUSIC RECORDING STUDIO RENTAL AGREEMENT
Music Recording Studio Rental Agreement
For the purposes of this Agreement, (a) a "Studio" is any type of musical recording space encapsulating music recording hardware/software equipment including but not limited to computers/laptops, audio interface, monitors (speakers), mixers, microphones, etc., made available through the Rex Studios website (the "Site"); (b) the "Artist" is the person renting the Studio using an account created on the Site, and the "Studio Owner" is the owner or authorized agent for the Studio made available for rent via the Site. This Studio rental agreement ("Agreement") is a binding agreement between Artist and Studio Owner. Rex Studios Official LLC ("Rex Studios") is a party to this Agreement solely to the extent necessary to facilitate the rental transaction and collect and pay any fees that may be owed hereunder, and is otherwise a third-party beneficiary of this Agreement.
Studio Owner enters into this Agreement and allows Artist to rent and use the Studio, along with any associated equipment (the "Rental") only on the condition that Artist and Studio Owner accepts all of the terms in this Agreement. By entering into this Agreement to rent and use the Studio, Artist and Studio Owner acknowledges that
- he or she has read and understood this Agreement;
- he or she agrees to be bound by all of the terms of this Agreement;
- he or she is knowledgeable with respect to the type of Studio equipment being rented and adjustments required for safe operation and use; and
- if Artist is not properly qualified with respect to Studio and equipment, as applicable, Artist is hereby advised to seek assistance of a qualified audio engineer with proper evaluation, adjustment and tuning of equipment.
IF YOU DO NOT ACCEPT THIS AGREEMENT, YOU WILL NOT BE PERMITTED TO RENT THE STUDIO.
This Agreement is effective on the date Artist and Studio Owner agrees to the terms and conditions as provided herein ("Effective Date").
Artist and Studio Owner agree as follows:
1. RENTAL
1.1 Agreement to Rent.
By accepting this Agreement, Studio Owner agrees to rent the Studio to Artist, and Artist agrees to rent the Studio from Studio Owner, on the terms and subjects to the conditions set forth herein, and for the period agreed via the Site (the "Rental Period").
1.2 Condition of Studio.
By making the Studio available for rent hereunder, and agreeing to the terms of this Agreement, Studio Owner represents and warrants that (a) he or she is the sole owner of the Studio, or that he or she has full agency or other authority to enter into this Agreement and to rent the Studio to Artist; (b) the Studio has been accurately described on the Site, including any known faults or mechanical issues; (c) except as clearly set forth on the Site, the Studio is in proper working condition, has been professionally maintained, and contains all functionality necessary for the Artist to attain his or her expected use of the Studio during the Rental Period.
1.3 Cancellations and Refunds.
All Rentals are subject to our Cancellation & Refund Policy, which is set forth as Exhibit A below.
1.4 Rex Studios No Guarantee.
At the moment, Rex Studios does not offer any guarantee to Studio Owners for Rentals. Studio Owners assume responsibility of obtaining the appropriate insurance coverage and mediating any disputes, damages, theft, vandalism, etc. of their Studio property and equipment, with the Artist and/or local authority. The Studio Owner assumes all responsibility and liability of any damages incurred on the music studio property and equipment.
The Artist and Studio Owner shall agree that any disputes, damages, theft, vandalism, etc., should be reported to the other party, and/or local authority if necessary twenty-four (24) hours of commencement of the Rental Period or prior to any subsequent rental, including photographic evidence of said damages, theft, vandalism, etc., else the claim shall hold no merit and damage shall be presumed to have occurred subsequent to the Rental. The Studio Owner shall retain sole, absolute, and unfettered discretion regarding the determination, implementation, and maintenance of any and all safeguards, security protocols, and protective measures deemed necessary for the operation of the premises. Such measures shall include, but are not limited to, the procurement and maintenance of comprehensive general liability insurance sufficient to cover risks associated with property damage, equipment loss, theft, vandalism, or any other unforeseen liabilities. The failure of the Studio Owner to implement specific security measures shall not be construed as a breach of duty or liability, and the Studio Owner assumes exclusive responsibility for assessing and mitigating all risks associated with the studio's assets and operations.
1.5 Studio Owner Obligations.
If there is damage to a Studio during a Rental, the Studio Owner must notify Rex Studios and the Artist within twenty-four (24) hours of commencement of the Rental Period or prior to any subsequent rental, whichever occurs first. If any damage is not reported during such period, then the damage shall be presumed to have occurred subsequent to the Rental. Studio Owner shall be responsible for the cost of any diagnostic fees, estimates, equipment/software/property replacements or repairs, etc.
If Studio Owner fails to appear at the scheduled time and place for Studio access, Studio Owner shall be responsible for any fees incurred by Rex Studios in connection with such delayed or cancelled Rental Period check-in time, including the No-Show Fee and Cancellation Fee set forth in Exhibit A (i) and Exhibit B. Rex Studios shall not be responsible for any delay or loss of use of the Studio due to Studio Owner's failure to appear as scheduled.
Studio Owner agrees to abide by Fees described in Exhibit B.
2. ARTIST OBLIGATIONS
2.1 Usage.
No other person may occupy the Studio except Artist and the number of people accompanying them as indicated in the rental listing. Artist is prohibited from surpassing the max capacity of the Studio at any time. Artist may not remove any Studio equipment from the premises, nor make any modifications to the Studio or its equipment. Artist may bring and connect the following personal equipment for use during the Rental Period: a thumb drive and/or portable hard drive for the purpose of saving audio files from the recording session, and/or a laptop computer with digital audio workstation ("DAW") software of Artist's choice, which Artist may connect to the Studio's audio interface. Any other personal equipment may be brought only with the Studio Owner's prior approval. Artist shall remove all personal equipment from the Studio at the end of the Rental Period. Artist is to treat Studio property and equipment with reasonable care before, during, and after use.
Artist must follow all laws, rules and regulations, as well as posted signs and warnings. Artist should always be aware of room conditions, as well as weather and other environmental factors which may affect safe operation of the Studio. Artist is responsible for securing the Studio at all times, including the use of locks or theft prevention devices made available, where appropriate.
2.2 Return.
Artist agrees to return the Studio to Studio Owner in the same condition as received, except for ordinary wear and tear and ordinary adjustments, on the checkout date and time as specified at time of rental. Artist understands that there will be additional charges if the Studio is vacated at a different time or date than indicated in this Agreement, including the Artist Late Checkout Fee described in Exhibit B. The Artist Late Checkout Fee equals the Studio's hourly rental rate multiplied by the number of hours by which Artist remains at the Studio past the scheduled checkout time, with any partial hour counted as a full hour and a minimum of one (1) hour, plus a $20 Late Checkout Fee. To claim an Artist Late Checkout Fee, the Studio Owner must report the late checkout through the Site within twenty-four (24) hours after the scheduled checkout time; a late checkout that is not reported within that period shall not be charged. Rex Studios will notify Artist of the report and will review it before any Artist Late Checkout Fee is charged.
If Artist fails to vacate the Studio at the agreed date, time, and has not agreed with Studio Owner or Rex Studios on an alternate checkout time within one (1) hour of the scheduled checkout time, or Artist fails to vacate the Studio at the rescheduled time and place, then (a) Rex Studios shall determine that Artist does not intend to vacate the Studio; (b) Rex Studios will charge Artist's payment method for the Artist Late Checkout Fee set forth above and in Exhibit B, along with any other fees due to Rex Studios; (c) Rex Studios or Studio Owner may contact local law enforcement to have Artist removed from Studio premises; and (d) Rex Studios and Studio Owner may exercise any other rights or remedies, and take any other necessary measures, to repossess the Studio and/or collect the full amount owed by Artist hereunder.
2.3 Repossession.
Studio Owner may repossess the Studio at any time if: (a) the Studio is used in violation of law; (b) it appears the Studio is abandoned, (c) the Studio is used in violation of any term or condition in this Agreement, (d) Artist made a misrepresentation to Studio Owner or (e) Artist fails to vacate the Studio when due. Studio Owner is not required to notify Artist in advance of repossession.
2.4 Prohibited Use.
Use of the Studio is restricted to the Rental Period time agreed upon by Artist and Studio Owner. Artist will not operate Studio outside of this period. Artist agrees not to use or permit the Studio to be used or contracted out for the use of a third-party. Artist will not use or permit the Studio to be used for an illegal purpose, including the transportation of a controlled substance or contraband. A violation of this paragraph automatically terminates the rental and makes Artist liable to Studio Owner for any penalties, fines, forfeitures, liens, recovery and storage costs, and any related legal expenses associated with a violation of this paragraph.
2.5 Damage to Studio.
The Studio Owner assumes sole, absolute, and exclusive financial and legal liability for any and all property damage, equipment loss, casualties, theft, or acts of vandalism occurring within or to the Studio premises. It shall be the exclusive obligation of the Studio Owner to procure, pay for, and maintain adequate comprehensive General Liability insurance coverage, property insurance, and commercial crime policies to fully insulate both the Studio and the Artist against such losses.
The Artist shall not be held liable for ordinary wear and tear, nor for any third-party actions, thefts, or structural damages beyond the Artist's direct physical control. In the event the Studio Owner alleges that specific, non-accidental damage was caused directly by the willful misconduct or gross negligence of the Artist and the damages are not covered by Studio Owner's policy, the sole and absolute burden of proof shall rest entirely upon the Studio Owner as they have within their rights to bring forth any lawsuit against Artist at their own expense and discretion.
Prior to initiating any formal claim, demand for monetary resolution, or legal prosecution against the Artist, the Studio Owner must independently investigate, gather, and present verifiable, competent, and contemporaneous physical or digital evidence conclusively establishing both the Artist's direct causation and the exact valuation of the damages. The Studio Owner further waives any right of subrogation, ensuring that the Studio Owner's insurance carriers may not seek recovery against the Artist for any claims paid under the owner's policies.
The Studio Owner and the Artist hereby mutually agree to hold Rex Studios entirely harmless and free from any liability, and expressly dismiss Rex Studios from any requirement or obligation to participate in mediation, dispute resolution, or legal proceedings between the primary parties.
2.6 Payment.
Artist agrees to pay upon demand all rates, charges, (including those applicable to miscellaneous services and equipment), plus applicable taxes, fees, and surcharges (if applicable), which may apply to the Rental. Artist specifically agrees and authorizes Rex Studios to apply any charges to the method of payment used by Artist at the time of rental.
2.7 Booking and Payment.
Submitting a booking request through the Site does not result in any charge to Artist. Charges for a Rental are processed only after the Studio Owner approves Artist's booking request and Artist completes payment through the Site. At that time, Artist authorizes Rex Studios to charge the amounts due for the Rental to the payment method Artist provides. Rex Studios is also authorized to make additional charges to Artist's payment method related to late checkout fees.
2.8 Repairs.
If Artist experiences any malfunctions with the Studio during the Rental period, Artist should immediately notify Rex Studios and Studio Owner to obtain authorization for repairs. Artist agrees that he or she will be responsible for any unauthorized repairs or modifications to the Studio. Artist understands that Studio Owner will not reimburse Artist for any authorized repairs without receipts. All repairs needed as a result of the use of the Studio will be performed at the normal labor rates and the cost of such repairs, including all parts, shall be paid by Studio Owner. If a malfunction compromises the safety or usability of a Studio during a Rental, the Artist should contact the Studio Owner immediately and arrange for return of the Studio to the Studio Owner. In such an event, if the Artist files a claim through the Site within twenty-four (24) hours of the Rental Period check-in time, attesting that Artist contacted the Studio Owner and forfeits all rights to any and all material recorded during the Rental, and Rex Studios approves it, the Artist shall be entitled to a full refund of the Total Rental Fee, and the Studio Owner shall be charged a $20 Cancellation Fee, as set forth in Exhibit A.
2.9 Ownership.
The Studio, at all times, remains the exclusive property of Studio Owner. Studio Owner is responsible for damage to Studio. If the Studio is destroyed or damaged beyond repair in the judgment of Studio Owner, the Studio Owner assumes the responsibility of taking any legal action if necessary, against the Artist. However, the Studio Owner also assumes the burden of obtaining supporting evidence. Rex Studios is absolved from any legal obligations.
3. RISK AND LIABILITY TERMS
3.1 Acknowledgement of Risks.
Artist understands and acknowledge that the Studio is provided "as is" and without warranties. Artist further understands and acknowledges that consuming alcohol and use of controlled substances or contraband are hazardous activities that entail known and unanticipated risks which could result in physical or emotional injury, paralysis, death, or damage to self, to property, or to third parties. Artist understands that such risks cannot be eliminated by Studio Owner without jeopardizing the essential qualities of this activity. The risks include, without limitation, falling, striking obstructions or other person, equipment failure, and temperature exposure (hypothermia, sunstroke, sunburn, heat exhaustion and dehydration).
3.2 Allocation of Risk; Insurance.
Consistent with Sections 2.5 and 4.1, the Studio Owner is solely responsible for any bodily injury, illness, or death of any person, and for any loss of or damage to property, occurring at the Studio during the Rental Period, including any such injury, illness, death, loss, or damage arising from the condition of the Studio premises or equipment or from the negligence of the Studio Owner or the Studio Owner's agents. The Studio Owner is solely responsible for procuring and maintaining comprehensive general liability insurance, and any property or other coverage, adequate to cover such events. A Studio Owner who elects not to maintain such coverage, or whose coverage proves insufficient, does so at the Studio Owner's own risk and shall bear the full cost of any such injury, illness, death, loss, or damage. Artist acknowledges the risks described in Section 3.1 and agrees to use the Studio and its equipment with reasonable care. Nothing in this Section relieves Artist of responsibility for injury or damage caused by Artist's willful misconduct or gross negligence, as provided in Section 2.5.
3.3 Waiver and Release of Rex Studios.
Rex Studios is not the owner or operator of any Studio and is a party to this Agreement solely to facilitate the Rental transaction. To the maximum extent permitted by applicable law, Artist and Studio Owner each release and forever discharge Rex Studios and its affiliates, officers, members, agents, and employees from any and all liability or claims for injury, illness, death, or loss of or damage to property arising from or related to any Rental, whether based upon negligence, breach of contract, breach of warranty, or any other legal theory. Any claim between Artist and Studio Owner arising from a Rental shall be pursued solely between those parties, and Rex Studios shall have no obligation to participate in any related mediation, dispute resolution, or legal proceeding.
3.4 Indemnification.
Studio Owner agrees to indemnify, defend, and hold harmless Rex Studios and its subsidiaries, agents, licensors, managers, and other affiliated companies, and their employees, contractors, agents, officers, and directors, and Artist, from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including attorney's fees) arising from bodily injury, illness, death, or property loss or damage occurring at the Studio during the Rental Period, except to the extent caused by Artist's willful misconduct or gross negligence. Artist agrees to indemnify, defend, and hold harmless Rex Studios and Studio Owner from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including attorney's fees) to the extent arising from Artist's willful misconduct, gross negligence, or breach of this Agreement. Should Rex Studios, or a party not in breach, be required to incur attorney's fees and costs to enforce this Agreement, the breaching party agrees to indemnify and hold them harmless for all such fees and costs.
4. THIRD-PARTY CLAIMS
Rex Studios shall not be responsible if Artist causes injury to another person. Responsibility for any injury, illness, death, or property loss or damage occurring at the Studio during the Rental Period, including injury to a third party, is allocated between Studio Owner and Artist as set forth in Sections 2.5, 3.2, 3.4, and 4.1.
4.1 Insurance.
Studio Owner certifies that he or she has adequate insurance to cover any injury or damage Artist may cause or suffer while participating in the rental activity, or else Studio Owner agrees to bear the costs of such injury or damage. Studio Owner understands and agrees that Artist and/or Rex Studios may make a claim against any insurance coverage Studio Owner maintains, whether liability, casualty, personal or health insurance, in the event of any loss, injury, death or damage to person or property while using or operating the Studio. Nothing in this Section 4.1, and neither Studio Owner's maintenance of nor failure to maintain adequate insurance, relieves Artist of Artist's obligation to use the Studio and its equipment with reasonable care, or excuses Artist from responsibility for injury, loss, or damage caused by Artist's willful misconduct or gross negligence. Without limiting the foregoing, any injury, illness, death, or property loss or damage caused by Artist, or by any person accompanying Artist, while under the influence of alcohol, drugs, or any controlled substance shall be treated as caused by Artist's willful misconduct or gross negligence for all purposes of this Agreement, including Sections 2.5, 3.2, and 3.4, and Artist shall remain fully responsible for it.
4.2 Physical Condition.
Artist understands the he or she should be in good physical health to participate in Studio recording session. Artist certifies that Artist has no medical or physical conditions which could interfere with Artist's safety in this activity, or else Artist is willing to assume all liability, damages or costs that may be created, directly or indirectly, by any such condition.
5. GENERAL PROVISIONS
5.1 No Warranty.
THE STUDIO IS PROVIDED TO ARTIST ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE STUDIO IS PROVIDED WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE. WITHOUT LIMITING THE FOREGOING, STUDIO OWNER DOES NOT WARRANT THAT THE STUDIO OR ANY RENTAL WILL MEET ARTIST'S REQUIREMENTS.
5.2 Limitation of Liability.
(a) TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL STUDIO OWNER OR REX STUDIOS, THEIR AFFILIATES, AGENTS, DIRECTORS, EMPLOYEES, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES, THAT RESULT FROM ANY RENTAL OR THE USE OF, OR INABILITY TO USE, THE STUDIO.
(b) THIS LIMITATION OF LIABILITY SECTION APPLIES WHETHER THE ALLEGED LIABILITY IS BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR ANY OTHER BASIS, EVEN IF REX STUDIOS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGE. THE FOREGOING LIMITATION OF LIABILITY SHALL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW IN THE APPLICABLE JURISDICTION.
5.3 Assignment.
This Agreement, and any rights and licenses granted hereunder, may not be transferred or assigned by either Studio Owner or Artist.
5.4 Third-Party Beneficiary.
Rex Studios shall be an intended third-party beneficiary of this Agreement with the full rights to enforce the provisions relating to Rex Studios herein.
5.5 Governing Law.
This Agreement shall be governed by the internal substantive laws of the State of California, without respect to its conflict of laws principles. The application of the United Nations Convention on Contracts for the International Sale of Goods is expressly excluded. Any claim or dispute between Artist and Studio Owner that arises in whole or in part from the rental of the Studio shall be decided exclusively by a court of competent jurisdiction closest to Studio Owner's residence.
5.6 No Waiver.
No waiver of any term of this Agreement shall be deemed a further or continuing waiver of such term or any other term, and a party's failure to assert any right or provision under this Agreement shall not constitute a waiver of such right or provision.
5.7 Entire Agreement/Severability.
This Agreement shall constitute the entire agreement between Artist and Studio Owner concerning the rental of the Studio. If a court of competent jurisdiction deems any provision of this Agreement invalid, the invalidity of such provision shall not affect the validity of the remaining provisions of this Agreement, which shall remain in full force and effect.
Exhibit A — Rex Studios Cancellation & Refund Policy
The following Cancellation Policy applies to all Rentals through Rex Studios.
- In the event a Rental is cancelled by Artist at any time prior to commencement of the Rental Period, then all funds shall be returned to Artist, less a flat $20 Rental Cancellation penalty, regardless of how far in advance notice is given.
- The Rental Cancellation penalty in Section (a) above is a flat fee: it does not vary with the amount of advance notice given, and no reduced penalty applies to cancellations made with more than forty-eight (48) hours' notice.
- In the event a Rental was booked with a Rental Period check-in time less than twenty-four (24) hours after the booking was made (a "same-day booking"), and the Rental is cancelled by Artist any time before commencement of the Rental Period, the same flat $20 Rental Cancellation penalty applies.
- If upon delivery of the Studio or within twenty-four (24) hours of the Rental Period check-in time, Artist reasonably determines that the Studio does not materially conform to the Studio Owner's description of the Studio, then Artist may notify Rex Studios of the deficiency by filing a claim through the Site and request a refund. Artist must end the Studio session immediately upon determining that the Studio does not materially conform, and forfeits all rights to any and all material recorded during the Rental; when filing the claim, Artist must attest that Artist ended the session immediately and forfeits such rights. Further, if Studio Owner does not deliver the Studio at the place and time agreed (a Studio Owner no-show), then Artist shall be entitled to a full refund (including Rex Studios fees), and Studio Owner will be charged a $20 USD No-Show Fee plus a $20 USD Cancellation Fee ($40 USD total), as set forth in Exhibit B. A Studio Owner no-show must be reported as provided in Section (i).
- If a Studio Rental must be canceled during the Rental Period due to a mechanical failure, and Artist reports it by filing a claim through the Site within twenty-four (24) hours of the Rental Period check-in time, the Artist will be eligible for a full refund of the Total Rental Fee, and the Studio Owner will be charged a $20 USD cancellation fee. Artist forfeits all rights to any and all material recorded during the Rental and must so attest when filing the claim.
- Refunds shall only be granted after commencement of the Rental Period in extraordinary circumstances. Artist and Studio Owner may mutually agree to reschedule a Rental Period after commencement, in which case Artist would receive a full refund, so as long as another Rental Period is booked and agreed upon by the Studio Owner and Artist.
- Studio Owner Cancellation Policy: Cancellations can have serious implications on an Artist's trip, therefore there are penalties that will be applied for a Studio Owner's cancellation. If a Studio Owner cancels any reservation, regardless of how far in advance notice is given, the Studio Owner will be charged a flat Cancellation Fee of $20 USD, and the Artist will be refunded the Total Rental Fee in full. In addition, if a Studio Owner cancels more than one reservation within a six-month period, the Studio Owner will be charged a flat Additional Cancellation Fee of $20 USD per additional cancellation, regardless of how far in advance notice is given (a total of $40 USD for each such additional cancellation). Authorization to collect fees. Studio Owner expressly authorizes Rex Studios to collect any fees Studio Owner owes under this Agreement, including cancellation fees and administrative fees, by (1) debiting the balance of Studio Owner's Stripe connected account, which transfers the amount owed to Rex Studios; (2) deducting the amount owed from Studio Owner's future payouts; or (3) if those means are insufficient, charging any payment method Studio Owner has on file, or taking such other actions to collect from Studio Owner as Rex Studios deems necessary or reasonable in its sole discretion. Studio Owner acknowledges that a debit may cause Studio Owner's Stripe balance to become negative, in which case Stripe may recover the negative amount from the bank account linked to Studio Owner's Stripe connected account. This authorization remains in effect for as long as Studio Owner has a Rex Studios account or owes any amount under this Agreement.
- Rex Studios shall determine all refunds in its reasonable discretion. In the event either Studio Owner or Artist is not satisfied with Rex Studios' determination, their sole recourse shall be to seek payment or refund of fees from the Artist or Studio Owner, as applicable.
- In the event Studio Owner or Artist fails to appear at the scheduled Rental Period check-in time (a "no-show"), the party who appeared must first attempt to contact the other party, and must report the no-show through the Site within twenty-four (24) hours of the Rental Period check-in time, attesting that they attempted to contact the other party; a no-show that is not reported within that period shall not result in any fee or refund. The party who failed to appear will be charged a $20 USD No-Show Fee plus a $20 USD Cancellation Fee ($40 USD total), as set forth in Exhibit B. If Studio Owner fails to appear, Artist shall receive a full refund as provided in Section (d). If Artist fails to appear, Artist shall be refunded the Total Rental Fee less the No-Show Fee and Cancellation Fee; if the Total Rental Fee is less than those fees, the difference will be charged to Artist's payment method. When Artist fails to appear, the $20 No-Show Fee is paid to Studio Owner and the $20 Cancellation Fee is retained by Rex Studios; when Studio Owner fails to appear, both fees are retained by Rex Studios. Rex Studios will notify the other party of the report and will review it before any fee is charged or refund is issued. The parties may mutually agree to reschedule the Rental as provided in Section (l); the no-show must still be reported as set forth above. If the parties reschedule, only the $20 USD No-Show Fee is refunded, and only upon successful completion of the rescheduled Rental, meaning the rescheduled Rental has been approved by the other party, paid for in full by Artist, its Rental Period has ended, and Studio Owner has marked it complete through the Site. The No-Show Fee is not refunded when the rescheduled Rental is approved or paid for, and is not refunded at all if the rescheduled Rental is cancelled, refunded, or not completed for any reason, including a further no-show. The No-Show Fee is refunded to the party who paid it; where Artist failed to appear, Studio Owner returns the No-Show Fee Studio Owner received. The $20 USD Cancellation Fee remains in effect and is not waived or refunded, whether or not the Rental is rescheduled.
- If a malfunction compromises the safety or usability of a Studio during a Rental, the Artist should contact the Studio Owner immediately and arrange for return of the Studio to the Studio Owner. In such an event, upon Rex Studios' approval of the Artist's claim, which must be filed through the Site within twenty-four (24) hours of the Rental Period check-in time with Artist's attestation that Artist contacted the Studio Owner and forfeits all rights to any and all material recorded during the Rental, the Artist will receive a full refund of the Total Rental Fee, and the Studio Owner will be charged a $20 USD cancellation fee.
- Each party should be aware that Artists and Studio Owners are entitled to post reviews on the Site with respect to cancelled Rentals.
- Rescheduling a Cancelled Rental: Either Artist or Studio Owner may propose, through the Site, a new Rental Period for a cancelled Rental (including a Rental cancelled because of a no-show). The proposed Rental Period must fall within the Studio's listed availability and may not overlap any other Rental of the Studio or any other Rental of the Artist. The rescheduled Rental is not confirmed until it is approved through the Site by the other party (Studio Owner, if Artist proposed it; Artist, if Studio Owner proposed it) and paid for in full by Artist. The rescheduled Rental is a new Rental under this Agreement: it is priced at the Studio's then-current hourly rate, the Rex Studios Rental Fee in Exhibit B applies, and this Cancellation & Refund Policy applies to it. A reschedule must be proposed through the Site within twenty-four (24) hours of the time the Rental was cancelled (or, for a Rental cancelled because of a no-show, of the time Rex Studios approved the no-show report); after that, the cancelled Rental can no longer be rescheduled and a new Rental must be requested instead. Any fees or refunds already assessed on the cancelled Rental are unaffected, except that the $20 USD No-Show Fee is refunded upon successful completion of the rescheduled Rental as described in Section (i); the $20 USD Cancellation Fee remains.
- Unpaid Balances and Account Suspension: Artist and Studio Owner can each view, through the Site, their account balance and a history of every charge, payment, payout, refund, and fee on their account, with the reason for each. A negative balance is an amount owed to Rex Studios under this Agreement. Studio Owner's balance may be paid by deduction from future payouts, by debit of Studio Owner's Stripe connected account as authorized in Section (g), or by card payment through the Site. Artist's balance may be paid by a charge to Artist's payment method on file or by card payment through the Site; while Artist owes any amount, Artist may not request new Rentals. If any amount owed remains unpaid for three (3) months after it was charged (or, for an amount that becomes owed again because a payout it was deducted from is reversed, three (3) months after that reversal), the account will be suspended. While suspended, a Studio Owner's listings are hidden and cannot be booked and Studio Owner may not list a new Studio, and an Artist may not request, pay for, or reschedule Rentals; the suspended party may still sign in to the Site and pay the amount owed. The suspension is lifted automatically once the full amount owed is paid. Suspension does not reduce or waive any amount owed, and Rex Studios may take any other collection action permitted by this Agreement.
